I’d say actual malice may be provable here (with my layman understanding), but would Biden need to be the one to sue even? Could the scientists who worked on this sue? They wouldn’t likely need to prove actual malice.
To prove malice it would be required to disprove incompetence. And no jury would be able to find that Trump isn’t incompetent. He may legitimately not know the difference between transgenic and transgender. Even after it’s explained to him he wouldn’t be able to tell the difference.
